2011 Golftunes Fantasy Golf Tournaments
Two (2) Separate Tournament Challenges
(1) The 2011 United States PGA Fantasy Tournament (GUSPGAFT)
(2) The 2011 European PGA Fantasy Tournament (GEPGAFT)

1 -Eligibility; The Golftunes Fantasy Golf Tournaments are organized in the United States, is subject to the laws of the United States and will be governed and interpreted under the laws of the State of Pennsylvania. The fantasy tournaments are open to persons who are legally competent and age to enter into legally binding agreements under the laws of the jurisdiction in which they reside at the time of entry. Some jurisdictions may not allow or may limit the validity of some or part of the provisions of these rules. It is expressly understood and agreed that such shall not limit the validity or enforceability of any other provision herein and any and all clauses contained in these rules will be valid to the fullest extent permitted under the applicable law. Employees of Golftunes LLC and its subsidiaries and advertisers are not eligible to participate in the fantasy tournaments. Sponsor reserves the right to terminate, modify or suspend these challenges or disqualify any participants in it sole discretion at any time and with no liability if it is notified by any authorized regulator the fantasy tournaments are prohibited by law. The fantasy tournaments are void in Belgium, Burma, Cuba, Denmark, Hong Kong, Iran, Libya, Malaysia, Netherlands, North Korea, Norway, Portugal, Quebec, Sudan, Sweden, and other state, province, country or territory where such fantasy tournaments are prohibited by national, state, provincial or any governmental laws or regulations.
2- Gambling Prohibited: The Golftunes Fantasy Tournaments are for entertainment purposes only and may not be used in connection with any form of gambling.
3- The Challenges: The 2011 Golftunes Fantasy Golf Tournaments consists of two(2) separate tournaments, first the Goftunes United States PGA Fantasy Tournament[GUSPGAFT] and second the Golftunes European PGA Fantasy Tournament[GEPGAFT]. You the “Player” may enter a team in one or both tournaments but you can only have one team per tournament. LIMIT ONE TEAM/ENTRY PER PERSON/EMAIL ADDRESS PER SEASON FOR EACH “GUSPGAFT’ AND “GEPGAFT” TOURNAMENT.
ANY PERSON OR PERSONS HAVING MORE THAN ONE TEAM PER TOURNAMENT WILL BE DISQUALIFIED.
4- How to play; log on to golftunes.com, pick the tournament either the “GUSPGAFT” or “GEPGAFT” you want to play in and complete the online registration form as a player. Then at that time you can pick your teams 10 pro golfers or elect to have the computer pick them for you at random. Then prior to each golf tournament and within the registration period you can make changes to your 10 pro golfers. Place the 10 pro golfers in the exact order you think they will finish in that week’s tournament. The fantasy tournaments and registration period for those tournaments are here:
If you do not select a new Pro Team for the next tournament’s game, the same team will carry over from the previous tournament. Your team’s selections or changes must be received by the Golftunes’ server within the online registration period listed above. Golftunes’ computer is the official clock.
REMEMBER LIMIT ONE PRO TEAM/ENTRY PER PERSON/EMAIL ADDRESS PER GAME/TOURNAMENT. ANY ATTEMPT BY ANY PARTICIPANT TO SELCT MORE THAN ONE PRO TEAM PER GAME BY USING MULTIPLE/DIFFERENT EMAIL ADDRESSES,IDENTITIES,OR OTHER METHODS WILL DISQUALITY THAT PARTICIPANT AND VOID THAT PARTICIPANT’S PRO TEAMS.
In the event that week’s golfers tournament is postponed and rescheduled, Golftunes will post notice on the web site as soon as practicable and the time frame to select or edit your team will be extended and posted on Golftunes. If for any reason the tournament is cancelled and not rescheduled that tournaments game points and prizes will be eliminated.
The pro golfers tournament must be at least 54 holes to qualify for any prizes and points with Golftunes.
5- Scoring—Points for each team is awarded in this way;
Pro golfer must make the cut and finish that week’s tournament to be awarded any points.
A. Base points are awarded for each pro golfer on your team based on your golfer’s total money won for that tournament
B. Each golfer you select that finishes in the top 10 of that weeks tournament earns your team (2X) two times his money won in that weeks tournament.
C. In addition, each golfer you select that is ranked in the exact position you placed them earns your team (3X) three times his money won in that weeks tournament.
6. Scoring Ties- Pro golfer tournament ties are broken in this order:
A. In event that week’s tournament ends a playoff for first place occurs with more than two golfers, golfers will be ranked to when golfer drops out of playoff competition.
B. Other wise ties are broken as follows; lowest 4th round score, then lowest 3rd round score, then lowest 2nd round score, then lowest 1st round score, then most eagles.
NOTE; No amateur golfer can score points in any of Golftunes fantasy golf tournaments, only pro golfers. If an amateur finishes in the top 10 in any pro tournament he will be dropped and the next pro golf will be placed in that spot.
7- Prizes- The player picking the top ten profession golfers in the exact order as they finish will receive the one million dollar prize . In event of a tie where more than one person selects the top ten in the exact order, a random will be conducted from among tied participants to determine the prize winner . Only(1) one million dollar can be awarded for the 2011 GUSPGAFT and 2011 GEPGAFT per each 2011 tournament.
Prize payout as follows;
One million dollar prize—US $25,000/yr over 40 years with no interest
One weekly prize for each GUSPGAFT and GEPGAFT tournament team to the top points total winner will receive a $20 gift certificate from Golftunestore.com.
One over all winner for each the 2011 GUSPGAFT and 2011 GEPGAFT with the most total points at the end of the 2010 season will receive a Par 5 Golf Package for the 2011 golf season at Toftrees Golf Resort in State College, Pennsylvania, USA which includes two nights accommodations, two breakfasts in LePapillon, three rounds of golf with card, $15.00 dinner certificate at the Down Under Steakhouse, bucket of range balls, two bottles of spring water, 10% discount at pro shop, tax and gratuities (does not included transportation to or from resort) plus $1500 gift certificate to Golftunestore.com.
8- General—Winner will be notified by email, or telephone. At Golftunes discretion a completion of an Affidavit or Declaration of Eligibility and Liability release and where legal publicity release prior to receipt of prize. All taxes related to the acceptance of a prize are the sole responsibility of the winners. By participating , players agree to these rules and decisions of Golftunes and to release Golftunes LLC , their advertisers and agencies and their respective employees, officers, directors, agents, and representatives from any liability of any kind resulting from their participation in this promotion. Golftunes LLC is not responsible and shall not be liable for any telephone, electronic, hardware or software program, network, internet or computer malfunctions, failures or difficulties of any kind including without limitation server malfunction or by any human error which may occur in the processing pro team selections and scores, plus late, failed incomplete or delayed computer transmissions or any condition caused by events that may cause the Goftunes promotion to be disrupted or corrupted. Golftunes LLc reserves the right in its sole discretion to cancel or suspend this promotion or any portion of it should viruses, bugs or other causes corrupt the administration security or proper play of these promotion. A pro team selections must be made by the player at the authorized web site of www.golftunes.com. Pro team selections may not be made by any other individual or any entity and/or originating at any other internet web site or email address including but not limited to commercial sweepstakes subscription notification and/or entering service sites. Golftunes reserves the right in its sole discretion to disqualify any player at any time in the event it is determined that the player is not in compliance with these official rules. In case of dispute, a pro team selections will be declared made by the authorized account holder of the email address used to participate at the time of entry. “Authorized account holder” is defined as the natural person who is assigned to an email address by an internet access provider, online service provider or other organization(e.g. business, educational institution) that is responsible for assigning email addresses for the domain associated with the submitted email address. If you are a Eagle Advantage or Mulligan Advantage Player note that any unauthorized use of the information contained at this web site will result in the immediate termination of access to the web site and forfeiture of the right to any winning connected to this Golftunes promotion.
ANY ATTEMPT BY A PLAYER TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITMATE OPERATION OF THIS GOLFTUNES PROMOTION MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE GOLFTUNES LLC RESERVES THE RIGHT TO SEEK DAMAGES FORM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.
9- Canadian Residents—Residents of Canada (excluding Quebec) , in order to win must first correctly answer a mathematical skill testing question.
10- Arbitration – Except where prohibited, players agree that any and all disputes, claims and causes of action arising out of or connected with this promotion or any prize award or the determination of the winners shall be resolved individually without resort to any form of class action and exclusively by arbitration pursuant to the rules of the American arbitration association then effective in Pennsylvania USA any and all claims and judgments and awards shall be limited to actual out of pocket costs incurred including cost associated with entering this promotion but in no event attorneys fees and under no circumstances will be permitted to obtain award for and player hereby waives all rights to claim punitive ,incidental and consequential damage and any other damages other than actual out of pocket expenses and any and all right to have damages multiplied or otherwise increased.
